Mr. Yadav submits that notices are yet to be issued in this petition. He states that the petitioner Arun Eknath Wankhedkar is present in the Court. He has tendered a photocopy of the petitioner's PAN Card, which is taken on record and marked "X" for identification.

Upon taking instructions from the petitioner, Mr. Yadav seeks permission to withdraw the petition with liberty to file a fresh petition on the same cause of action on the ground that there are formal defects in the petition. 4.

As notices are yet to be issued to the respondents and nobody has entered appearance, as also having regard to the fact that no effective hearing has taken place, on the motion made by Mr. Yadav, the petition is allowed to be withdrawn with the liberty as prayed for. The petition accordingly stands disposed of.
