By the present application, the applicant seeks modifcation of condition No.(vi imposed in the order dated 07/09/2018. By the said condition, the applicant was directed to report to the concerned police station on frst Saturday of every month between 10.00 to 12.00 noon till the completion of the trial. Pertinent to note that the said condition was M.M.Salgaonkar
2/2 45 IA-1193-22.doc subsequently modifed by the order dated 28/08/2019 and the applicant was directed to report to the concerned police station once in three months on the frst Saturday of the month between 10.00 a.m. to 12.00 noon till the conclusion of the trial, considering the engagement of the applicant as Vice President in Sales and Marketing Department, which requires him to travel frequently for business purpose. 2.
Down the line, for four years, the applicant is abiding by the condition of attendance and the prosecution has no grievance that he has ever altered.
The learned A.P.P. states that the charge-sheet is fled and if the applicant abide by Condition No.(vii imposed on him by order dated 07/09/2018, the interest of the prosecution shall be protected.

In the wake of the above statement, since the period of more than fve years has expired from the date of passing of the order, the applicant is entitled for relaxation of condition of attendance. Instead, he shall comply with condition No.(vii. 4.
