1] Heard the learned counsel for the applicant and the learned APP for the State. Perused the record of investigation. 2] By a reasoned order dated 13th March 2019 the applicant was granted interim relief.

3] The learned APP, after perusing the record and on instructions, submitted that, the allegations made in the present complaint by the Village Development Officer and the enquiry conducted 1/2

osk 20-aba-626-2019.odt by the Divisional Commissioner, Konkan Division, Navi Mumbai, is pertaining to the same allegations mentioned therein. 4] As noted earlier, the Divisional Commissioner, Konkan Division, Navi Mumbai, has already exonerated the applicant from the charges, after conducting a detailed enquiry. 5] In view thereof, the custodial interrogation of the applicant for further interrogation of the present crime is not necessary. Interim relief granted by order dated 13th March 2019 is hereby confirmed.
