Heard Mr.J.G.Aradwad(Reddy) the learned counsel for the applicant. Heard Mrs.M.R.Tidke, the learned Additional Public Prosecutor for the respondent/State.

The learned counsel for the applicant submits that the applicant intends to visit United States of America for getting appropriate medical treatment. It is submitted that an appointment with a Doctor in the USA has already been fixed on 20th April 2015. It is submitted that the present application was 1/3

made on 18th March 2015, but remained pending before the Court since then.

The learned Additional Public Prosecutor, on instructions of P.I.-S.A.Bagwe, Investigating Officer, who is present in the Court, states that there is no objection to permit the applicant to visit USA as prayed for by him on imposition of appropriate and suitable conditions.

The application is allowed.

The applicant shall be permitted to depart from India and be in the USA during the period from 20th April 2015 to 30th June 2015 on the following conditions :

(a) The applicant shall deposit cash of Rs.1,00,000/- (Rupees One Lakh only) and execute an appropriate bond as and by way of additional security for his appearance before this court. (b) The applicant shall not visit any country except USA.

(c) The applicant shall give his address and telephone numbers while in the USA, where he would be available for communication, in writing, to the Investigating Officer,.

(d) The applicant shall give, in writing, to the 2/3

Investigating Officer the relevant details such as: Flight Number, Ticket Number, Visa, the number of persons accompanying with him, if any, and their names etc., before his actual departure from India.

(e) The applicant shall return to India on or before 30th June 2015 and report to the Investigating Officer and to the trial Court, within a week thereafter.
