Learned APP upon instructions submits that in the present case Learned Sessions Court has concluded recording of evidence and the next scheduled date is 10/1/2017. In view of this, it would not be appropriate to consider the application under section 439 of the Code of Criminal Procedure, 1973. Hence, the applicant does not deserve to be enlarged on bail. Hence, the application stands rejected and disposed of accordingly.
