1] As directed by this Court, the Applicant has filed Affidavit sworn before the Superintendent, Thane Central Prison dated 23.09.2022. In the said Affidavit following statements are made in Para Nos.5 to 8: "

I Dharmendra Govind Singh is an applicant affirmed that I am ready and willing to deposit the Rs.3,02,500/- (Rupees Three lakh Two Thousand and Five Hundred only) in court.

I am in Custody from last 29/10/2021 and my wife is suffering from Cancer her treatment is going on at TATA Hospital, I can deposit the amount in the instalments. 7.

The schedule of depositing the amount are follow :

Date Amount 29.09.2022 Next date after receiving Rs.50,000/- of order 29.10.2022 Rs.1,00,000/- 29.11.2022 Rs.1,00,000/- 29.12.2022 Rs.52,500/- 8.

I say that I ready to deposit the said amount with the Registrar of Session Court at Vasai, Palghar, and/or before the Registrar General, Criminal Appellate Jurisdiction Bombay High Court, Mumbai."

2] The said statement is accepted as an Undertaking to the Court, as the case of the prosecution is to the effect that the Applicant is beneficiary of sum of Rs.3,02,500/-. Let the amount be deposited in the Vasai Court, Palghar in MPID Special Case No.246/2021. 3] In the wake of aforesaid Undertaking, the Applicant need not be remained incarcerated. Needless to state that if the amount is not deposited as per Undertaking, the prosecution will be at liberty to seek cancellation of bail.

Hence, the following order :

O R D E R

(a) Application is allowed.

(b) Applicant - Dharmendra Govind Singh shall be released on bail in connection with C.R.No.I1163/2021 registered at Tulinj Police Station, Palghar, Police Station on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount.

(c) The Applicant shall deposit the amount of 2/3

Rs.3,02,500/- in the Vasai Court, Palghar in MPID Special Case No.246/2021 as undertaken by him vide Affidavit dated 23.09.2022.

(c) The applicant shall report to the concerned Police Station on first Monday of trimester between 10.00 a.m. to 12.00 noon.

(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.

(e) The Applicant shall regularly attend trial, on every date, unless exempted.

(f) Upon release, the Applicant shall submit his residential address and contact number to the Investigating Officer and shall keep the Investigating Officer updated about change, if any.
