Heard the learned counsel for the parties.

This application is for fixing early date of hearing of Second Appeal No.541 of 1998 on the ground that applicant is a Senior Citizen.

The learned counsel for the applicant further submits that earlier they preferred Civil Application No.150 of 2013 for same cause of action. Same was allowed by this court by order dated 28.2.2013.

Considering the submissions made by the learned counsel for the Applicant, the averments made in the Application and the earlier order dated 28.2.2013 passed by this court in Civil Mohite 1/2

15 cas668-15.doc Application No.150 of 2013, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order: a) Hearing of Second Appeal No.541 of 1998 is expedited in the category of Senior Citizen.

b) Office is directed to place the matter in the weekly board for final hearing in the list of Senior Citizen as per its turn.

c) Civil application stands disposed off accordingly.
