The applicant's previous application for bail was rejected by me. (Bail Application No.1600 of 2014 decided on 14th August 2014.) 3.

Now the prayer for bail has been renewed mainly on the ground that subsequent to the rejection of the applicant's previous bail application, co-accused similarly placed have been released on bail either by this court or by the trial Court itself. 1/3

The application for bail (Bail Application No.1531 of 2014) filed by co-accused Prakash Chavan was also earlier rejected - i.e. by an order dated 14th August 2014 itself - but later on i.e. on 11th March 2015, he was released on bail (Bail Application No.458 of 2015), as, in the mean time a co-accused - Sudarshan Javir - was released on bail by this court [Bail Application No.1987 of 2014 (Coram : P.D.Kode J.)] 5.

There is substance in the submission of the learned counsel for the applicant that the case of the present applicant cannot be treated differently from that of the co-accused, who have been released on bail.

The application is allowed.

The applicant is ordered to be released on bail in the sum of Rs.30,000/- with one surety in the like amount on the following conditions :

(a) The applicant shall not contact, meet, or approach any of the prosecution witness, in any manner, whatsoever.

(b) The applicant shall report to the Khopoli Police Station on first Sunday of each calender month till the disposal of the case against him.

Notwithstanding the release of the applicant on bail, the trial Court shall ensure that the trial is completed by 31st October 2015, as assured by it.
