1) The learned APP upon instructions submits that in the present case, i.e. Sessions Case No. 492 of 2015, pending before Sessions Court at Thane, the Court has recorded the substantive witness of two witnesses. In view of this, it would not be appropriate to consider the application under section 439 of the Code of Criminal Procedure, 1973.

2) Application stands disposed of.

3) The learned Sessions Court seized with Sessions Case No. 492 of 2015 is requested to make an endeavour to expedite the trial, not grant unwarranted adjournments to the prosecution and also ensure that the accused is produced before the court on each and every date. Office to communicate this order to the concerned court, forthwith.
