Learned counsel for the applicant fairly submits that it is due to to passage of time that subsequent application has been filed since earlier application was heard on merits and thereafter, it was withdrawn. 2) Learned APP upon instructions submits that charge has not been framed, although charge-sheet is filed in February 2014. 3) Learned counsel for the applicant prays for expeditious trial and seeks liberty to withdraw the application.
