The facts giving rise to filing of the present petition in all respects are identical to the facts arisen in decided petition, viz. Writ Petition No. 11568 of 2013, by the Division Bench of this Court on 8th April, 2014. For the reasons recorded in the judgment and order aforesaid petition, instant petition can be disposed of by giving following directions: (i) After obtaining a permit under rule 21 of the 1 / 2

12 - WP. 5615-18.doc Maharashtra Foreign Liquor (Import and Export) Rules, 1963, it will be open for the Petitioner to make an application under rule 22 of the said Rules to the Collector;

(ii) If such an application is made, the same shall be considered in the light of rule 23 and appropriate order shall be passed thereon as expeditiously as possible and, in any event, within a period of three weeks from the date of which the application is made by the Petitioner;

(iii) The writ petition is disposed of in the aforesaid terms;

(iv) Parties to act upon an authenticated copy of this order.
