Adv. Ms. Shah states that she received instructions to appear on behalf of respondent. She undertakes to file her vakalatnama within one week from today. Undertaking is accepted.

By this Petition under Article 227 of the Constitution of India, the petitioner plaintiff is challenging the order dated 06.11.2015 by which Small Causes Court, Mumbai issued notice to the respondent/defendant in application for execution of decree under order 21 Rule 11 of Code of Civil Procedure, 1908.

21 wp 3690-16=.doc giving reasons, the following order is passed: a) The learned counsel for the defendant waives service in application of execution of decree under Order 21 Rule 11 of Code of Civil Procedure, 1908 preferring by petitioner plaintiff in Small Causes Court, Mumbai.

b) Respondent/defendant undertakes to file their Affidavit-in-Reply in the said Execution Application on or before 13.04.2016 and serve copy on other side.

c) Small Causes Court, Mumbai is directed to decide the Petitioner's/plaintiff's application for execution in any case, on or before 30.04.2016. d) Writ Petition stands disposed of accordingly.
