The above Misc. Civil Application is filed by the Applicant wife seeking transfer of Hindu Marriage Petition No.31 of 2015 filed by the Respondent seeking divorce before the Civil Judge, Sr. Division at Satara to the Family Court at Bandra, Mumbai. Admittedly, the Applicant is residing with her parents at Dadar - Mumbai since 20-05-2013. Despite being unemployed, she has since May-2013 not received any maintenance from the Respondent, who is working as a private car driver. She is finding it extremely inconvenient to travel from Dadar to Satara the distance being 700 kms. (to and fro). She has no friends or relatives residing at Satara and she is unable to make arrangements at Satara for an overnight stay. No one from her family is in a position to accompany her to Satara. As against this, the Respondent husband is attending the Court in Mumbai to defend the criminal proceedings filed by the ssp 1/2

mca 104 of 2015 (910).sxw Applicant under Section 498A of the Indian Penal Code, 1860. 2.

In view of the above facts, I am satisfied that this is a fit case to allow the above Misc. Civil Application and transfer the Petition filed by the Respondent before the Civil Judge, Senior Division, Satara to the Family Court at Bandra, Mumbai. Hence, the following order is passed :

(i) H.M.Petition No.31 of 2015 filed by the Respondent before the Civil Judge, Senior Division, Satara is transferred to the Family Court, Bandra, Mumbai. (ii) The parties shall appear before the Principal Judge, Family Court at Bandra and obtain necessary directions on 21 st June, 2017 at 11.00 a.m.

(iii) The above Misc. Civil Application is accordingly disposed of. ( S.J.KATHAWALLA, J. ) ssp 2/2
