This is second application for bail. The earlier application was decided by order dated 24th July, 2017. The said application was allowed tobe withdrawn by observing that after arguing the application for some time, when the Court was inclined to grant any relief, the permission was sought to withdraw the application.

Learned counsel for the applicant submits that the applicant is in custody since 28th September, 2015. It is submitted that there is no speedy progress in the Appeal.

rpa 2/2 ba-701-18.doc The applicant was arrested in connection with C.R.No.I-211, registered with Kalyan Taluka Police Station for the offences punishable under Sections 302, 394, 397 and 120(B) of the IPC.

Learned APP submitted the report of the investigating officer. In the said report. It is stated that the trial has commenced and the prosecution has examined two witnesses and the next date before the trial Court in 7th July, 2018. The first witness was examined on 22nd November, 2011 and the second witness was thereafter examined on 20th February, 2018. Learned APP submits that there are about 24 witnesses as per the list submitted in the charge-sheet. However, which witnesses are to be examined is yet to be decided. Considering the fact that the applicant is in custody since 2015 and in the light of the fact that two witnesses are already examined, it is expected that the trial Court would endeavour to conclude the trial as expeditiously as possible.
