P. C. :- 1.
Heard learned Advocate for the Applicants, learned APP for the Respondent-State as well as learned Advocate for the FirstInformant. 2.
After hearing them and after going through the papers, I am not inclined to grant anticipatory bail. It is for the reason that there are specific allegations against these Applicants about role played by them. It also mentions what are the weapons they have used. 3.
There are two injured persons. One is the First-Informant and another is Thakurdas Yashwant Patil. Out of them, First-Informant Omkar Patil has received more serious injuries. Though initially, offence under Section 326 of Indian Penal Code, 1860 ["IPC"] was not invoked, after the medical certificate, it was invoked. He took treatment first in Indira Gandhi Hospital and thereafter, to a private hospital.
4.
Learned APP from the investigation papers, shown to me those certificates and also the statements recorded of the witnesses including injured. Furthermore, there are criminal antecedents against the Applicant - Premkumar and Applicant - Haresh. Allegations are there and custodial interrogation is required. 2/3
5.
Hence, Application is rejected.
6.
Interim Application is also disposed of.
7.
All the parties to act on an authenticated copy of this order. 8.
It is made clear that the observations made herein are prima facie, and the trial Court shall decide the case on its own merits, in accordance with the law, uninfluenced by the observations made in this order.
