The appeal challenges the order passed by the City Civil Court dated 20 February 2015 refusing to grant ad-interim relief in Notice of Motion No.865/2015 taken out by the appellant for seeking to restrain the respondents from interfering with the possession of the appellant. While refusing the ad-interim relief, the learned City Civil Court Judge has recorded that prima facie the appellant is not in possession of the property. Thereafter the appeal is filed on 24 March 2015 and has not even been circulated to obtain any urgent order.

At this stage it is not possible to consider the prayer for ad-interim relief. It is open to the appellant to make appropriate request for early hearing of the notice of motion which the City Civil Court will consider keeping in mind the earlier time-bound commitments.

The appeal is accordingly disposed of. In view of disposal of the appeal, Civil Application does not survive and is disposed of. (N.M. JAMDAR, J.)
