Learned APP on instructions of Superintendent, Nashik Road Central Prison, submitted that, in furtherance of order dated 3rd February 2020 passed in Criminal Writ Petition No.4339 of 2018, the request of Petitioner for reconsideration to send him to open prison, has been considered and same has been rejected. 2.

In view thereof, the Petitioner will be having substantive cause of action to challenge the said Order.
