1] After arguing the matter for some time, the learned counsel for the petitioner seeks leave to withdraw this petition with liberty to the petitioner to question the impugned order dated 31st January 2017, in case, Regular Civil Suit No. 2009 of 2012 is ultimately decided against the petitioner and the petitioner chooses to institute an appeal against such judgment and decree.

2] In case, Regular Civil Suit is decided against the petitioner and the petitioner chooses to institute an appeal against such judgment and decree, it is always permissible for the petitioner to challenge the impugned order dated 31st January 2017. Therefore, by granting such liberty, the petitioner is permitted to withdraw the present petition.
