Learned Counsel for the respondent produces a photocopy of the order dated 27th January, 2015 passed by original civil jurisdiction of this Court in Notice of Motion No. 1019 of 2014 in Suit No. 590 of 2014. He submits that the respondent has filed another suit in respect of the same property against the appellant on the original side of this High Court. The consent terms were filed on 27th January, 2015 wherein it is mentioned in Clause No.11 that the defendant i.e. the present appellant undertakes to withdraw S.C. Suit No.754 of 2014 filed by him in the City Civil Court at Bombay and Appeal From Order No. 410 of 2014.

Perused the impugned order and the consent terms, the same are taken on record and marked as Exhibit-"A" for identification.

In view of above, nothing remains in this Appeal From Order, and hence, it is disposed of.
