By this application, the applicant seeks the following substantive prayer:

"(b) This Hon'ble Court be pleased to transfer the Criminal M.A. No. 1089 of 2010 from the Court of Hon'ble J.M.F.C Court, Pune to the Court of Honourable Family Court, Pune and be heard along with the Petition PA No. 428 of 2016."

The applicant has filed DV proceedings i.e. Criminal Misc. Application No. 1089/2010 in the Court of the learned Judicial Magistrate SQ Pathan 1/2

15-APPLN-124-2021.doc First Class, Pune, as against the respondent No. 1 and the respondent No. 1 has filed petition PA No. 428/2016 in the Family Court for divorce as against the applicant.

Learned counsel for the respondent No. 1 has no objection if the DV proceeding is transferred to the Family Court, Pune. Accordingly, the application is allowed in terms of prayer clause (b).
