At the outset, Ms. Hemangi Pathare, learned counsel for the applicant submits that the delay is of 57 days and not 4 days. She therefore seeks leave to amend the prayer clause (a). Leave is granted. Amendment to be carried out forthwith.

Heard the learned counsels for the respective parties. By this application, the applicant has sought to condone the delay of 57 days in filing the appeal.

In view of the reasons stated in paragraph 3 of the application, which in my considered view, constitute sufficient ground, civil application is allowed. Delay is condoned. Appeal be registered, after office objections, if any, are removed.
