These are the two civil applications moved by the Applicant for stay.

This Court vide order dated 5 August 2019 in Civil Application No.2828/2016, was pleased to grant interim stay subject to depositing entire amount as per the impugned award, within a period of eight weeks with the concerned Tribunal. Mamta Kale

It appears that the Applicant failed to deposit the entire amount within eight weeks and filed another Civil Application (St) No.30560/2017 for the same relief.

Ms. Nikita Singh i/b. Res Juris, learned counsel for the Applicant seeks leave to place on record copy of communication alongwith photo copy of the cheque.

Leave granted. Copy of communication alongwith cheque are taken on record. She submits that the applicant has deposited entire amount of Rs.40,88,521/- vide cheque No.596372 with the Motor Accident Claims Tribunal at Malegaon. As such, the conditional order has been complied with. It is necessary to confirm the conditional stay order passed by this Court dated 7 August 2017.

ORDER

(i) The Civil Application No.2828/2016 for stay stands allowed in terms of prayer clause (b). (ii) The Civil Application (St) No.30560/2017 for the same relief stands simply disposed of. (iii) Inform to concerned Court accordingly.
