DATE : NOVEMBER 28, 2018 P.C.:- On behalf of the State, an affidavit of Mr.Ramchandra Kondiba Dhanawade, Deputy Secretary, Housing Department, Government of Maharashtra, Mumbai-32, has been filed. The said affidavit is in the nature of compliance report in respect of providing premises and infrastructure to the Competent

2 3) wp5188-14.doc Authorities exercising powers under Maharashtra Rent Control Act, 1999. The factum of the Aurangabad Division being established in so far as the Rent Control Act is concerned has also been mentioned in the said affidavit. The affidavit also adverts to the steps taken to provide the Competent Authorities with the necessary staff.

In so far as the Competent Authority at Nagpur is concerned, presently, the said Competent Authority has been provided government premises until other suitable premises become available. We expect that the same would also be done at the earliest.

In the light of the said affidavit dated October 9, 2018, it appears that the compliance in respect of providing the Competent Authority with premises as well as infrastructure has substantially been done.

In our view, therefore, it is now not necessary to keep the above writ petition pending. The petition to accordingly stand disposed of.

The Petitioners are always at liberty to file an application if they come across any fact which discloses that the Competent Authority at a particular place does not have the necessary infrastructure. If such application is filed, the disposal of the writ petition will not come in the way of the Petitioners from pursuing such an application.
