DATE :

.

We have heard learned counsel for the parties on the Civil Application No. 984 of 2018 filed on behalf of the Applicants who are not party in the Writ Petition.

2.

While deciding the Writ Petition, this Court vide order dated 12th October, 2017 has merely directed to the Joint Charity Commissioner to decide both the applications filed under Section 41(E) of the Maharashtra Public Trusts Act, 1950 and the Vishal Parekar 1/2

chamber caw-984-2018.doc application filed by the second Respondent of the said Writ Petition under Section 36(1) (a) of the said Act, together as expeditiously as possible and preferably within a period of four months from the date of receipt of copy of this order. In the circumstances, it is clear that this Court has not expressed any opinion about the Applicants' rights and interest and merely direction was given to decide the application within a time limit.

3.

In the circumstances, we are of the view that no case is made out to invoke the review jurisdiction which is extremely limited for the applicants who are not party in the Writ Petition as the order passed in Writ Petition will not affect in any way the Applicants' rights and interest.

4.

The Civil Application No. 984 of 2018 is therefore, rejected.

(G.S. KULKARNI, J.) (SHANTANU KEMKAR, J.) Vishal Parekar 2/2
