Heard learned counsel for the parties. Perused the impugned order dated 12 February 2016. It is not necessary to interfere with the impugned order as the learned Small Causes Court Judge, Mumbai has not rejected the application on merits but in view of certain procedural non-compliance. Therefore, if the Petitioner complies with the lacunas pointed out by the learned Judge in the impugned order and submits a fresh application, the learned Small Causes Court Judge will no doubt consider the same on its own merits and pass appropriate orders. With this clarification, Writ Petition is disposed of.
