This application is preferred by Mr. Aditya Agarwal seeking transfer of D.V. Application 4 of 2021 pending before the learned Metropolitan Magistrate, 18th Court at Girgaon, Mumbai to the learned Family Court-5, at Bandra, Mumbai in which Court Divorce Petition A-298 of 2022 instituted by the non-applicant/ wife, is pending.

Both the parties have been persuaded by their learned counsel to agree to the following consent order. (i) With consent, D.V. Application 4 of 2021 which is pending before the learned Metropolitan Magistrate, 18th Court at Girgaon, Mumbai shall stand transferred to the learned Family Sneha Chavan page 1 of 2

64 mca 165-22=.doc Court-5, at Bandra, Mumbai and shall be tagged with Divorce Petition A-298 of 2022.

(ii) Both the proceedings shall be expedited and neither party shall seek any unnecessary adjournment. (iii) The next date of hearing in the Family Court is 16.07.2022.

(iv) According to the wife, she has already filed her affidavit of disclosure of Assets and Liabilities in the D.V. proceeding in which she has claimed maintenance. The husband undertakes to file his affidavit of disclosure of Assets and Liabilities in the D.V. proceeding on 16.07.2022. (v) The learned Family Court is requested to decide the application for interim maintenance which is filed in the D.V. Proceeding as expeditiously as possible and in any event on or before 15.08.2022.
