Inasmuch as the Appeal filed by the Petitioner is dismissed by the School Tribunal on the technical ground of maintainability as there was no prayer in the Memo of Appeal in respect of reduction in rank (though there was a specific ground raised in the memo of Appeal in that regard), the present Writ Petition is disposed of by passing the following order:

O R D E R

(i) The Petitioner is granted liberty to file a fresh Appeal before the School Tribunal.

(ii) Time spent in prosecuting the Appeal before the School Tribunal and pendency of the present Writ Petition shall be considered by the School Tribunal in condoning the delay in filing the Appeal. 2.
