None appears for the petitioner when the matter is called out today. Heard Mrs. Pai, learned APP for the State. 2.

When the matter was called out yesterday, nobody appeared on behalf of the matter. It seems that the petitioner is not interested in prosecuting the matter. Be that as it may, by this petition, the petitioner is seeking direction to alter the charges from Sections 498 A, 306 to Section 302 of the Indian Penal Code, 1860. 3.

Learned APP, on instructions, submits that the subject FIR is already investigated and charge-sheet is also filed on 8th April, 2015 under Sections 498A and 306 of the Indian Penal Code, 1860. Shubhada S Kadam 1/2

In these circumstances, the petitioner is always at liberty to apply to the Sessions Court under Section 216 of the Code of Criminal Procedure, 1973, at appropriate stage. In that view of the matter, we are not inclined to entertain the petition. The petition is, accordingly, dismissed.
