During the pendency of this Petition, as there was no restraint order, the police have filed charge-sheet. The learned Counsel appearing for the Petitioner has produced for perusal of the Court a copy of the charge-sheet. Charge-sheet has been filed for the offences punishable under sections 420, 467, 468 and 340 of the Indian Penal Code read with section 52 of the Maharashtra Regional and Town Planning Act, 1966. Therefore, a remedy of filing appropriate Application before the concerned Court is now available to the Petitioners. In view of this subsequent development, by keeping open the said remedy, the Petition is disposed of. Rule is discharged. All contentions raised by the Petitioners are expressly kept open.
