Perused the papers, more particularly the letter dated 23rd February 2015 by which the respondent has sent letter to the complainant company along with three post dated cheques towards the discharge of liability of the borrower under the facility agreement. 3.

In view of this the application seeking leave to appeal deserves to be allowed 4.

The respondent shall mark their presence before the learned Magistrate i.e 33rd Court, Ballard Pier, Mumbai within four varsha

The respondent shall also give an undertaking that they would appear before the said Court once in six months on the date assigned by the learned Magistrate.

Upon failure to attend any two consecutive dates, the learned Magistrate shall make report to the High Court and the prosecution would be at liberty to seek cancellation of bail. 10.
