The above Civil Application has been filed seeking condonation of delay of 28 days in filing the above Family Court Appeal. The above Civil Application was on board yesterday, but at the request of Mr. U. P. Warunjikar appearing for the Respondent/Husband was adjourned for today on the ground that the Respondent would like to file an affidavit. The learned counsel appearing on behalf of Applicant/Appellant states that an affidavit was served upon her yesterday. The learned counsel holding for Shri. Warunjikar, however states that he does not have the copies of the said affidavit. The above Civil Application was specifically kept today at the request of Mr. Warunjikar. We therefore requested the learned counsel for the Applicant/Appellant to give us her copy of the affidavit.

923.96.17 CAM The Application for condonation of delay of 28 days is opposed on the ground that no sufficient cause is made out. We have perused the Civil Application and the reasons mentioned for the delay. We are satisfied that case for exercise of discretion is made out.
