This is an application under Section 378(4) of the Cr.P.C. seeking leave to file appeal against the judgment and order dated 27.09.2009 passed by the J.M.F.C. Court No.1 at Malegaon in Summary Criminal Case No.1254 of 2006, thereby acquitting Respondent Nos.1 and 2 from the offence punishable under Section 37(1)(3), 135 r/w.33(W) of Bombay Police Act. 2.

Heard Mr. Patwardhan, learned counsel for the Applicant and perused the record.

The record indicates that, the said case was instituted on a police report and the first information report was lodged by Police Sub-Inspector Mr. Nanasaheb Patil. It appears from the record that, the applicant was neither the first informant nor a witness in the said crime. The applicant has no locus standi to file the present application. The present application is misconceived and is accordingly rejected.
