The facts of this case are more or less same as the facts in the companion writ petition, Writ Petition No.3652 of 2018, which is disposed of today by a speaking order. The challenge in that petition was to the same miscellaneous application as in the present case, though on a complaint filed by another union. The issue involved in the two petitions is the same. Accordingly, for the reasons stated in today's order passed in Writ Petition No.3652 of 2018, the present petition is dismissed in the same terms. As in that case, even here, statement of learned Counsel for the Respondent for deletion of the reference to the Municipal Commissioner by his name in the complaint is accepted and the name of the Commissioner shall stand deleted from the complaint though the Commissioner shall continue to be a party to the complaint by his designation and all rights and contentions of the parties on merits are kept open.
