Pursuant to the order dated 17th February 2017 passed by the Delhi High Court, the aforesaid petition has been filed by the petitioner in this Court.

Considering that prayer is for quashing and setting aside of the order dated 13th May 2015 passed by learned Sessions Judge, Dwarka Court, Delhi, learned counsel for the petitioner seeks leave to withdraw this petition with liberty to file an appropriate petition, in the event, any adverse order is passed by any Court in Mumbai, pursuant to the transfer of the case from Delhi to Mumbai.
