Pursuant to earlier order dated 7 December 2015 and in view of Affidavit filed by the Appellant dated 7 December 2015, and specifically in view of averments so made including undertaking so given in the Affidavit, learned Counsel appearing for the Respondent-wife, on instruction of Suhasini Sunil Kulkarni-Respondent-wife who is present in Court, states that he has no objection to permit the Appellant-husband to withdraw the present First Appeal.

No third person/party will be affected by this. It is made clear, by consent of parties, that the amount already deposited in the Trial Court shall be permitted to be withdrawn by the Respondent-wife. The AppellantUday P. Kambli 1/2

2/2 fca-63-13.doc husband has no objection for such withdrawal. It is also agreed that monthly payment shall be paid directly in the Account of the Respondentwife, the number of which will be provided by the Respondent-wife within three days, every month on due date as per the order of the Trial Court. 3.

So far as access to child is concerned, it is agreed that that will continue as per the order passed by the Trial Court. 4.
