The petitioners' claim that they are entitled for being considered and granted the benefit of pension and gratuity scheme, in terms of Clause XVII of G.R. dated 10th August, 2016. According to the petitioners, they have tendered their resignations after serving 20 or more years of service with the institutions run by the respondents.

According to the petitioners, the question involved in this petition has been decided by the Division Bench of this Court in the case of Vidharbha Ayurved Mahavidyalaya and 1/2

19. WP 4343-17.doc Ors. Vs. State of Maharashtra and Ors. in Writ Petition No. 5771 of 2011 and other connected matters vide judgment dated 10 th June, 2013 .

Today when the matter came up for hearing, learned Counsel for the petitioners prays to dispose of the petition by directing the respondents to consider the petitioners' claim keeping in view of the law laid down in the case of Vidharbha Ayurved Mahavidyalaya (supra) as also the said G.R. dated 10th August, 2016.

Having regard to the aforesaid, without commenting upon the merits of the matter, we direct the respondents to consider the petitioners' claim as aforesaid and take appropriate decision on it in accordance with law, as expeditiously as possible, but in any case not later than three months from the date of receipt of copy of this order.

With the aforesaid directions, the petition is disposed of.
