Learned APP has tendered a copy of the order dated 17.02.2016 passed by this Court (CORAM : SMT.ANUJA PRABHUDESSAI, J.) in an Application preferred by the co-accused Mahendra Mukund Kamble, Umesh Hanumant Jamkar & Nikhil Gajanan Thakur. The said order dated 17.02.2016 reads thus :- "The learned counsel for the Applicant, under instructions seeks leave to withdraw the application with liberty to file fresh application after the

The application is dismissed as withdrawn."

Considering that the Applicant is an accused in the same C.R., it would be appropriate that the same order is passed. Accordingly, the Applicant is permitted to withdraw this Application with liberty to file a fresh Application after the evidence of the prosecutrix is recorded. The Application is disposed of.
