1] This is an application under Section 439 of Cr. P.C. for bail in CR No.I-27 of 2016 dated 9.6.20167 registered with Navhasheva Police Station, District-Raigad under Section 407, 468 r/w 34 of the Indian Penal Code.
2] Learned Counsel for the applicant submitted that all accused persons in the present crime have been released on bail including accused persons who were having antecedents at their dis-credit. In support of his
2/3 contention, he placed reliance on an Order dated 6th March 2017 passed by this Court in Bail Application No.2575 of 2016. The record indicates that same or similar role has been attributed to the present applicant that has been attributed to other accused persons who have been released on bail. 3] The record further indicates that by an Order dated 28.8.2017 the applicant was directed to produced documents pertaining to his permanent place of residence and the property owned by the applicant or his wife or parents. Accordingly, the applicant has submitted the said documents.
Learned APP on instructions submitted that the documents of property which stands in the name of wife of the applicant lying and situated at village Jaspur, District-Udhamsingh Nagar, State of Uttarakhand are genuine and bonafide.
4] In view thereof, the applicant can be released on bail. Hence the following Order:
(i) The applicant be released on bail in CR No. I-27 of 2016 registered with Navhasheva Police Station, District-Raigad on his furnishing PR bond of Rs.15,000/- with one or two solvent local sureties in the like amount.
(ii) After his release from the jail, the applicant shall attend
3/3 the concerned Police Station once in a month i.e. on every 1st Monday of month between 11.00 a.m. to 2.00 p.m. (iii) The applicant shall also attend all the dates before the Trial Court.
(iv) Any two consecutive defaults in complying with the aforesaid conditions, shall attract the provisions of cancellation of bail.
(v) Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
