Heard learned Counsel for the applicant and the learned A.P.P. 2.

The applicant has been convicted by the learned Metropolitan Magistrate, 52nd Court at Kurla, Mumbai, vide Judgment and Order on 29th November, 2013, in C.C.No.437/PS/2003, for the offences punishable under Sections 279, 337, 304A of the Indian Penal Code and has been sentenced to suffer RI for 6 months, for the offences punishable under Sections 279 and 337 of the Indian Penal Code, and sentenced to suffer RI

2/3 for 1 year and to pay a fine of Rs.5,000/-, in default to undergo SI for 1 month, for the offence punishable under Section 304A of the Indian Penal Code. The said order of conviction and sentence has been confirmed by the learned Additional Sessions Judge in Appeal, vide Judgment and Order dated 3rd March, 2016.

Learned Counsel for the applicant states that the applicant was on bail, pending the trial and his appeal and that he has not misused the liberty granted to him.

Accordingly, the sentence of the applicant is suspended and the applicant is enlarged on bail on the following terms and conditions:-

ORDER

(i) The Applicant be released on cash bail in the sum of Rs.10,000/- for a period of three weeks;

(ii) The Applicant shall thereafter furnish P.R. Bond in the sum of Rs.10,000/- with one or two local sureties in the like amount, within a period of three weeks of his release on cash bail.

The Application is allowed in the aforesaid terms and is accordingly disposed of.
