Heard learned counsel for the Applicant. This is an application by Appellant / original Plaintiff seeking following interim relief : "(a) pending the hearing and final disposal of the above First Appeal, the Respondent Company its servants and all persons claiming through or under them be restrained by an order and injunction of this Hon'ble Court from transferring the shares/share certificates of the Respondent Company in any manner whatsoever, without the express written consent of the Applicant".

Record shows that by order dated 28.03.2019 this Court had granted interim protection in terms of Order dated 10.07.1996 until further orders. Learned counsel for the Applicant submitted that after Husen

40-CAF-1161-2019.doc the Order date 10.07.1996, the notice of motion was finally made absolute by Order date 29.08.1998. Office note shows sole Respondent is duly served. No appearance is filed. None appeared for the Respondent.

Considering the fact that the order dated 28/03/2019 is holding the field for a long time, this interim application is allowed. Interim protection granted under order dated 28.03.2019 shall continue to operate till disposal of the Appeal. 4.

The Applicant-Appellant is directed to file certified copies of order dated 10.07.1996 and 29.08.1998 passed in Notice of Motion No. 1875 of 1996 in Suit No. 2349 of 1996.
