DATE : 18 DECEMBER 2023 P.C. :- The Petitioner has challenged the election process held on 3 April 2022 in respect of the Shubh Chintak Heights, Cooperative Housing Society in which the Petitioner is stated to be a member. It is more than settled that the challenge to the election process ordinarily will not be examined in the writ jurisdiction when there is an appropriate remedy under the governing statute is available where all questions including the questions of fact can be decided.

In the light thereof, we dispose of the Writ Petition keeping all contentions open.

The learned Counsel for the Petitioner states that the adinterim order granted in this Petition be continued. The ad-interim order was deferment of election process till the next date. The last date is of 15 June 2022. Thereafter, when it was adjourned to 13 July 2022, the matter is not listed. It is listed on board in due course.
