The above Writ Petition has been filed for a direction to the Respondent No.2 to issue the passport to the Petitioner. The passport is sought on the ground that the Petitioner would like to travel to West Germany, where his son is working. It is required to be noted that the Petitioner has been convicted of the offence punishable u/s 304 Part I of the IPC and is also a Respondent in the Appeal filed by the State against his acquittal Nesarikar

In view thereof, it is not possible to accede to the request of the Petitioner for a direction to be issued to the Respondent No.1/Passport Authority.

The Writ Petition is accordingly dismissed.
