Learned counsel for the applicant, on instructions, seeks leave to withdraw the present application. 2.

I am informed that the trial is proceeding. Three witnesses have already been examined and eight witnesses remain to be examined. Since the trial has commenced, I am not inclined to entertain the present application. 3.

This Court by order dated 22/02/2023 in Bail Application No. 533 of 2022 of the co-accused has already observed that the trial Court shall endeavor to conclude the 1/2

Darshan Patil 933-ba-829-23.doc trial as early as possible. In this view of the matter, as in any case, the trial is progressing, the application is allowed to be withdrawn with liberty to apply after 3 months if there is no substantial progress in the trial.

The application is disposed of in the above terms. 5.

Needless to mention the trial Court shall endeavor to conclude the trial as early as possible.
