The fact remains that the order impugned passed by the learned District Judge clapping injunctions against the Petitioners is in existence since last more than 3 years. The evidence of the Plaintiffs is already concluded, whereas the Petitioner-Defendant completed evidence of his two witnesses.

As such, it can be inferred that the suit is itself at the concluding stage / advance stage.

In the aforesaid background, no case for interference is made out. The petition fails, dismissed.

The trial Court in the aforesaid background and having regard to the fact that the suit is more than 5 years old, hearing of the same be expedited, to be finally decided within six months from today. ( NITIN W. SAMBRE, J.)
