The Petition is filed for direction to the respondent to register an F.I.R. on the basis of the petitioners' complaint dated 18.12.2014, copy of which is annexed at Exhibit-A. 3.
Ms. Mhatre, learned A.P.P, having taken instructions from the officer concerned, states that at the instance of Ms. Sakshi Pujari, Inspector Postal Department, F.I.R No.381/2014 is registered with Mahim Police Station on 19.11.2014 for the offences punishable under sections 420, 467,468, 471 read with Section 34 of the Indian Penal Code against Umesh Doshi. She also states that the petitioner's supplementary statement is also recorded on 27.11.2014. She placed for perusal a copy of the F.I.R. as well as the petitioner's statement dated 27.11.2014. Learned A.P.P submitted that subject matter of the said F.I.R. and subject complaint is one and the same. Second F.I.R. cannot be registered on the basis of the subject complaint of the
2 / 2 WP/1253/2015 petitioners. She also states that the petitioners are at liberty to give supplementary statement which will be recorded and appropriate investigation shall be carried out accordingly. Statement accepted.
