Mr. Todi, applicant appearing in person through video conferencing, submits that inadvertently, in the order dated 16th October 2023, it is recorded that the matter to stand over to 30th November 2023 instead of 30th October 2023.

Ms. Kudtarkar, learned counsel for respondent no. 1 does not dispute the aforesaid. Accordingly, in the order dated 16th October 2023, para 4 now shall be read as 30th October 2023 instead of 30th November 2023. The said order to be corrected accordingly.

Vide order dated 16th October 2023, we had directed the office to verify whether the aforesaid appeal would be maintainable or family court appeal under section 19 was maintainable. Accordingly, registry had submitted its report dated 27th October 2023. As per para 12 of the said report, the appeal which is registered as Criminal Appeal ought to be registered as family court appeal under section 19 of the Family Courts Act. 4.

In view of the report, the applicant/appellant who appears in person seeks leave to convert the aforesaid appeal into family court appeal. Leave granted. Amendment to be carried out within two weeks. The amended copy to be served upon learned counsel for the respondent.
