The above Writ Petition has been filed seeking a direction to be issued to the Respondent No.3 to register an FIR in respect of the complaint comprised in the Petitioner's letter dated 21/10/2016, Exhibit E to the above Petition.

The said letter dated 21/10/2016 is addressed to Shri Dattatraya Shinde, Superintendent of Police, Sangli. The complaint of the Petitioner is as regards the exchequer allegedly being defrauded to the tune of Rs.Three Crores and Twenty Five Lakhs in the matter of the land in question not being converted from its original user and without the same being converted to NonAgricultural use. It seems that the said complaint was forwarded to the Collector, lgc

(14) wp-1285.17 Sangli. It seems that thereafter the inquiry was delegated to the Additional Collector, Sangli. The Additional Collector, Sangli by his letter dated 27/02/2017 addressed to the Petitioner has informed the Petitioner that the N.A. Order dated 08/02/2016 has been stayed pending the proceedings. Hence the proceedings have already been initiated by the Additional Collector, Sangli inquiring into the conversion of land in question as Non-Agricultural land which proceedings are pending. Since the Revenue Authorities are seized with the matter, we do not deem it appropriate to issue any directions of the nature sought by the Petitioner. It would be for the Revenue Authorities to register an FIR in respect of the allegations made in the complaint of the Petitioner dated 21/10/2016, if they so deem it appropriate.

We do not express any opinion in that regard. However, in passing, we would like to direct the Additional Collector, Sangli to culminate the proceedings relating to the inquiry into the aspect of conversion of land in question into the Non-Agricultural as expeditiously as possible. With the aforesaid directions, the above Writ Petition is disposed of.
