Pursuant to the order passed by this Court dated 30th March, 2015, the medical report of complainant Roshan S. Sahani is produced by the prosecution. The applicant/accused is facing charges under sections 326, 324, 323, 506 r/w. 34 of the Indian Penal Code in C.R. No. 56 of 2014 registered with Wakad Police Station, Pune.

The applicant/accused along with other two accused caught hold of the complainant and they assaulted the complainant with wooden log. It is the case of the prosecution that applicant held the hands of the complainant and he was holding chopper.

The learned counsel for the applicant/accused submitted that accused Sumeet hit the complainant. He further submitted that two accused were granted anticipatory bail.

Learned APP opposed the Application. He submitted that there is no criminal antecedent against applicant/accused. 5.

Perused the medical certificate of the complainant. It shows that the injuries sustained to the complainant are of simple nature. There is no criminal antecedant against the applicant/accused. Hence, pre-arrest bail is granted to the applicant/accused on the following terms and conditions:

O R D E R

(i) Application is allowed.

(ii) In the event of arrest, the applicant/accused be enlarged on bail upon furnishing P.R. Bond in a sum of Rs.15,000/- with one or two sureties in the like amount;

(iii) The applicant shall not tamper with the evidence. (iv) The applicant shall not pressurize the complainant. (v) The applicant shall not indulge into any criminal activity. (vi) The applicant is directed to attend the concerned police station on every Friday between 4 p.m. to 6 p.m. till the filing of the charge sheet and shall cooperate the Investigating officer.
