Learned APP on instructions from Superintendent, Kalyan District Prison, Kalyan submitted that, Petitioner was being regularly produced before the Trial Court till 15th December, 2022, except on few occasions for want of police escort. She submitted that, hearing of the MCOC Special Case No. 9 of 2012 has already commenced before the learned Additional Sessions Judge, Thane and as of 15th December, 2022 the prosecution has examined 12 witnesses. That, next date of hearing of said case is now scheduled on 4th January, 2023. 2.

In view thereof, the grievance of the Petitioner in the present Petition as of today does not survive and the Petition is accordingly disposed off.
