After arguing for sometime, the Learned Counsel Mr. Cama, on instructions of the Petitioner who is personally present in Court makes a statement that the Petitioner would not press the above Petition. Since the Petitioner intended to challenge the impugned order in this Court, the Petitioner did not proceed with the cross-examination of the Respondent, on account of which a no cross order came to be passed against the Petitioner. The Learned Counsel Mr. Warunjikar appearing for the Respondent on instructions of the Respondent who is personally present in Court states that the Respondent has no objection to the cross-examination to be continued, however the same should be directed to be completed within a particular time frame.

wp-3967-16-(37) The order of no cross is accordingly set aside. The Petitioner is accordingly allowed to cross-examine the Respondent. The Trial Court i.e. the Learned Judge of the Family Court No.2, is directed to see to it that the crossexamination of the Respondent is completed expeditiously and not grant unnecessary adjournments.

Subject to the above, the Petition is disposed of as not pressed. [R.M.SAVANT, J] mmj
